Terms of Use

Welcome to the Day Flow mobile application, operated by 42apps LLC ("we", "us", or "our"). These Terms of Use ("Terms") govern your use of our application and services (the "App" or "Services"). By using the App, you agree to comply with these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms
By downloading, accessing, or using the App, you agree to be bound by these Terms, whether you are a Visitor (browsing the App) or a Member (registered user). If you do not agree, you must discontinue use immediately.

2. Registration & Account Security
Some features may require account registration. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account.

3. Privacy Policy & Data Storage
Your use of the App is subject to our Privacy Policy, which describes how we collect and process data. Notably:

• Local Data Storage: All task data and events are stored locally on your device and synchronized with your connected calendars (Apple Calendar, Google Calendar, and Reminders) without involving external servers.
• Speech Recognition: The App uses on-device speech recognition for voice input. No raw voice recordings are stored or sent to external servers.
• AI Processing: Requests made to our AI assistant are processed via OpenAI API, with only textual queries sent for response generation.
• Third-Party SDKs: We use Apphud (subscription management), Amplitude (user analytics), Firebase (bug tracking), and Facebook SDK (advertising tracking). Please refer to our Privacy Policy for more details.

4. Proprietary Rights
All intellectual property rights in the App and Services (excluding user-generated content) are owned by 42apps LLC or its licensors. You may not copy, modify, distribute, or use our content without authorization.

5. Auto-Renewable Subscriptions
Some features require a paid subscription. By subscribing, you agree to the following:

• Billing: Payments are charged via the App Store or Google Play at confirmation of purchase.
• Auto-Renewal: Subscriptions renew automatically unless canceled at least 24 hours before the renewal date.
• Management: You can manage and cancel your subscription via your Apple ID or Google Play settings. We do not handle cancellations or refunds directly.
• Trial Periods: If offered, trial periods automatically convert to paid subscriptions unless canceled before the trial ends.

6. Integration with External Services

• Calendar Sync: The App integrates with Apple Calendar, Google Calendar, and Apple Reminders to synchronize events and tasks.
• Third-Party Dependencies: We are not responsible for service interruptions caused by external platforms (e.g., Google, Apple, or OpenAI).

7. Modifications to Terms & Services
We may update these Terms or modify the Services at any time. Continued use after changes indicates acceptance. We will notify users of significant updates where applicable.

8. Termination of Use
We reserve the right to suspend or terminate your account if you violate these Terms or misuse the App. You may also discontinue use at any time.

9. Limitation of Liability
We provide the App "as is" and do not guarantee uninterrupted service. To the extent permitted by law, we disclaim liability for any damages resulting from your use of the App.

10. Governing Law
These Terms are governed by the laws of Kazakhstan, without regard to conflict of law principles.
